SCBA Requests Vehicle Exemption from BS-VI Rules for Advocates
The Supreme Court Bar Association seeks relief for advocates from new vehicle emission standards in Delhi, citing commuting challenges.
SCBA has formally requested exemptions for advocates' vehicles from BS-VI emission standards in Delhi.
The restrictions on non-compliant vehicles are set to begin on November 1, 2026.
Many advocates commute daily from neighboring states, and the new rules could disrupt their ability to fulfill professional duties.
The Supreme Court Bar Association (SCBA) has formally approached the Supreme Court's administration, requesting intervention regarding the impending restrictions on vehicles that do not meet BS-VI emission standards in Delhi. In a letter dated October 31, 2026, SCBA Honorary Secretary Pragya Baghel highlighted the potential difficulties that these regulations could impose on advocates commuting to the Supreme Court.
The SCBA's letter specifically addressed the restriction on vehicles registered outside Delhi that do not comply with BS-VI standards, which is set to take effect on November 1, 2026. This regulation is part of a broader initiative by the Delhi Government aimed at controlling winter pollution and reducing vehicular emissions, which are significant contributors to the city's air quality issues.
In the correspondence, the SCBA noted that a considerable number of advocates travel daily from areas such as Noida, Ghaziabad, Faridabad, and Gurugram. Many of these legal professionals, particularly junior lawyers, rely on their personal vehicles to attend court proceedings and meet their professional obligations. The Bar Association expressed concern that the proposed restrictions would create significant hardships for these members, potentially disrupting the administration of justice.
The SCBA emphasized that advocates play a crucial role in the judicial system and that any limitations on their daily commute could adversely affect their ability to perform their duties effectively. The letter urged the Supreme Court Registry to engage with the Delhi Government and relevant authorities to consider possible exemptions or relaxations for advocates needing to travel to the Supreme Court.
This request follows a similar appeal made by the Delhi High Court Bar Association, which also sought exemptions for judges and lawyers from the proposed vehicle restrictions. The regulations will prohibit non-BS-VI compliant vehicles from entering Delhi from November 1, 2026, to January 31, 2027, with certain exemptions for CNG and electric vehicles, as well as emergency service vehicles.
