Maharashtra Cabinet Approves Rs 5 Lakh Compensation for Custodial Deaths

In a significant move, the Maharashtra state cabinet, led by Chief Minister Devendra Fadnavis, convened on Tuesday to approve a new compensation policy aimed at addressing custodial deaths. Under this policy, families of victims who die due to police assault, torture, or undue pressure will be entitled to a compensation of Rs 5 lakh, provided the cause of death is substantiated.
The policy outlines specific compensation structures based on the severity of injuries inflicted by police personnel. If a victim suffers less than 50% permanent disability due to physical or mental torture, their family will receive Rs 2 lakh. In cases where the disability is 50% or greater, the compensation amount increases to Rs 4 lakh. However, it is important to note that compensation will not be granted for deaths resulting from natural causes, such as old age or pre-existing medical conditions prior to custody.
To ensure accountability, the superintendent or commissioner of police in the relevant district will be responsible for reviewing such cases and must submit a proposal within 30 days. The policy also stipulates that if any police officer or administrative staff is found culpable in custodial death cases, they may face criminal charges. Furthermore, the policy includes provisions for recovering the compensation amount from the salaries, pensions, or properties of those found negligent.
