Court did not quash the FIR but limited Maharashtra police's interference.
In a significant ruling, the Karnataka High Court has declared that the investigation conducted by the Maharashtra police against two pan masala trading companies in Tumakuru is invalid. The court emphasized that the operation was executed without the necessary coordination with the local police, violating constitutional and statutory safeguards.
The case arose from an FIR filed at the Vadagaon police station in Maharashtra, alleging violations under the Food Safety and Standards Act and the Bharatiya Nyaya Sanhita. Following this, officers from Vadagaon police visited the Tumakuru businesses, confiscating documents and instructing the partners to report to the Vadagaon police station. The petitioners argued that these actions were taken without the local police's involvement, which is essential for such investigations.
Upon reviewing the relevant legal provisions, particularly Section 179 of the Bharatiya Nyaya Sanhita, the court noted that the petitioners' operations in Tumakuru fell outside the Vadagaon police's jurisdiction. This lack of jurisdiction rendered the Maharashtra police's actions unsustainable, as they failed to comply with the necessary legal protocols.
Despite ruling against the Maharashtra police's investigative actions, the court did not impose a complete ban on their contact with the petitioners or their business activities. The court maintained that the Maharashtra police could still engage with the petitioners within the framework of specific directions issued in the ruling. Additionally, the court rejected the petitioners' request to quash the FIR or halt the ongoing investigation entirely.
Looking ahead, this ruling underscores the importance of jurisdictional authority in police investigations. It sets a precedent for how inter-state police operations must be conducted, ensuring that local law enforcement is involved in matters that fall within their jurisdiction. The implications of this ruling may lead to more stringent protocols for cross-border investigations in the future, emphasizing the need for collaboration between state police forces.
