On October 13, 2026, a petition led by Rahul Gandhi and other opposition leaders seeking complete disclosure of records from the Election Commission of India (ECI) was not listed for hearing. This petition, which also calls for an independent investigation into alleged unilateral actions by Chief Election Commissioner Gyanesh Kumar, was filed on the evening of October 12, coinciding with a march to the Supreme Court by Gandhi and other leaders.

The petition was initiated following a communication from the Chief Justice of India (CJI) on October 11, which responded to a request from Gandhi and Congress president Mallikarjun Kharge to meet with the CJI. The CJI had indicated that similar matters were scheduled for hearing on October 13, and he encouraged the opposition leaders to file their petition within a designated time frame.

However, the Supreme Court Registry has indicated that the petition is currently facing routine clerical defects, which have prevented it from being listed. According to Supreme Court rules, petitioners are typically provided a specific time to rectify any defects before the matter can proceed. If not resolved within the initial period, a further application may be required to address the defects.

Gandhi's petition reportedly contains over ten clerical errors, including issues related to court fees and missing documents. His legal team has expressed confidence that these defects can be rectified in due course and noted that the substantive legal arguments in the petition have not been challenged by the Registry.

In the meantime, another petition filed by Gandhi is being heard by a bench led by the CJI, which contests an Allahabad High Court order directing investigations into allegations of disproportionate assets against him. Gandhi has argued that these allegations constitute a “witch-hunt,” and the Supreme Court has previously emphasized the importance of adhering to natural justice principles in such proceedings.
