Imran Khan Faces Departure Order Amid Protests in Mumbai
Actor Imran Khan, an OCI cardholder, is ordered to leave India by October 28 after participating in a political protest.
Imran Khan received a notice to leave India for participating in a protest.
Senior lawyer Mahesh Jethmalani argues Khan's OCI status limits his rights in India.
The notice cites provisions of The Immigration and Foreigners Act.
Actor Imran Khan has been issued a notice by Mumbai Police requiring him to leave India by October 28, following his involvement in a protest on October 10 in Mumbai. The demonstration called for the resignation of Chief Election Commissioner Gyanesh Kumar. Khan, who holds both U.S. citizenship and an Overseas Citizen of India (OCI) card, plans to challenge this order in the Bombay High Court.
The legal basis for the departure order stems from specific provisions under The Immigration and Foreigners Act, which empower authorities to restrict the movement of foreign nationals. Senior advocate Mahesh Jethmalani, defending the notice, stated that as an OCI holder, Khan does not possess the same rights as Indian citizens, emphasizing that he should demonstrate in the U.S. rather than India.
Jethmalani highlighted that the privileges associated with an OCI status come with the obligation to adhere to Indian laws. He argued that Khan's participation in the protest was inappropriate given his status, stating, "You don't have allegiance to a country... you haven't accepted the citizenship of this country." He further asserted that if Khan wishes to protest, he should do so in the United States, his country of citizenship.
The implications of this case extend beyond Khan, as it raises questions about the rights of OCI holders and the treatment of foreign nationals participating in political activities in India. Jethmalani's comments suggest a broader concern regarding the motivations of young protesters, linking them to external influences. This has sparked discussions about national sovereignty and the limits of political expression for non-citizens in India.
Looking ahead, the Bombay High Court is expected to hear Khan's challenge against the departure order soon. This case could set a precedent regarding the rights of OCI cardholders in India and the government's authority to regulate foreign participation in domestic protests.
