The Allahabad High Court has stayed the conviction of Nandlal Rai, allowing him to contest the upcoming Uttar Pradesh Assembly elections.
Nandlal Rai's conviction in a 2017 murder case has been stayed by the Allahabad High Court.
The court emphasized the right to livelihood and political participation for individuals facing conviction.
Rai aims to contest the 2027 Uttar Pradesh Assembly elections, potentially on a BJP ticket.
In a significant legal development, the Allahabad High Court has temporarily stayed the conviction of Nandlal Rai, a man found guilty in a 2017 murder case. The ruling, issued on October 19, 2026, allows Rai to pursue his intention to contest the upcoming Uttar Pradesh Assembly elections, either as an independent candidate or on a ticket from the Bharatiya Janata Party (BJP).
The bench, comprising Justice Siddharth and Justice Vinai Kumar Dwivedi, made this decision during the hearing of Rai's criminal appeal. Rai was convicted in 2025 for the murder of Pramod Kumar Nigam, an active participant in the Ram Janmabhoomi movement. The court noted that Rai's right to livelihood and political participation is equally important as the rights of politicians to contest elections.
In its order, the court highlighted the Supreme Court's previous rulings that have allowed public representatives to suspend their convictions to avoid losing their opportunity to contest elections. The judges referenced a 2023 Supreme Court decision that emphasized the unique responsibilities of politicians towards their constituents, which informed their decision to grant Rai bail.
Rai's legal team argued that he was not named in the initial FIR and that his alleged involvement surfaced only after a significant delay. They contended that the conviction was based on unreliable eyewitness accounts and a questionable recovery of the murder weapon. The state opposed the bail application but could not effectively counter the arguments presented by Rai's counsel.
The court's ruling not only grants Rai bail but also imposes certain conditions, including the requirement to deposit half of the imposed fine within a month of his release. The court has directed that the appeal's paperwork be prepared promptly, ensuring that the case will be heard in due course. This decision marks a pivotal moment in the intersection of law and politics in Uttar Pradesh, as Rai prepares for a potential political comeback in the upcoming elections.
