Maharashtra Reiterates Licensing Rules for Cultural Centres
The Maharashtra government clarifies that the July circular on orchestra permissions does not apply to cultural centres.
Cultural centres in Maharashtra remain under existing licensing rules.
The July 27 circular is specific to hotels and restaurants hosting live orchestras.
New applications from cultural centres will follow established local regulations.
In a recent clarification, the Maharashtra government has reaffirmed that cultural centres and public entertainment venues will continue to operate under their existing licensing frameworks. This announcement, made by the state home department, specifies that the circular issued on July 27 regarding orchestra permissions is not applicable to these establishments.
The clarification was prompted by inquiries from the Satara district collector, who sought guidance on how to handle license applications from cultural centres. The main concern was whether these applications should adhere to the public entertainment rules set forth under the Maharashtra Police Act or the 2016 Act concerning obscene dance in hotels and restaurants.
To eliminate any confusion, the home department has instructed police commissioners and district collectors to process new license applications and renewals for cultural centres according to the established regulations in their respective areas. This directive emphasizes that the July circular's provisions do not extend to entertainment categories beyond those specifically mentioned.
This clarification is particularly significant for operators of cultural centres and similar establishments as it ensures that their licensing applications will be evaluated based on the current jurisdiction-specific rules rather than the recent July guidelines. The official communication from Deputy Secretary Sanjay Dhondu Dagale has been made available on the Maharashtra government's website.
Despite this clarification, it is important to note that cultural centres are not exempt from licensing requirements, nor are existing conditions relaxed. The directive merely delineates the applicable regulatory framework for these venues, ensuring that they continue to comply with the established licensing norms.
