Hundreds of homebuyers in Maharashtra are grappling with the financial strain of stalled housing projects, as they continue to pay home loan EMIs for properties they cannot occupy. Many are also burdened with monthly rent, leading to a dual financial crisis. Despite securing refund orders from the Maharashtra Real Estate Regulatory Authority (MahaRERA), the process of recovering their money has proven to be a daunting challenge.

The situation has escalated for these buyers, as winning a refund order often leads to further complications. They face sluggish recovery proceedings, frequent administrative changes, and insolvency cases involving developers, resulting in prolonged financial distress. Many buyers have been waiting for years to reclaim their investments, draining their savings and adding to their emotional turmoil.

A MahaRERA official indicated that homebuyers could file a non-compliance plea if developers fail to honor refund orders. However, even after obtaining favorable orders, the actual recovery process can be painfully slow. Execution of recovery warrants is dependent on district collectorates and tehsildars, and buyers have reported delays due to frequent transfers of officials and inadequate follow-up. Additionally, property auctions intended to recover dues from defaulting developers have not translated into actual payments, leaving buyers uncertain about when they will receive their funds.

The challenges intensify when developers enter insolvency proceedings before the National Company Law Tribunal (NCLT), which can impose a moratorium on individual recovery actions. This complicates the enforcement of existing MahaRERA orders, pushing repayment further out of reach for many homebuyers.

Affected individuals, such as John Dantis and Vishal Raut, have shared their distressing experiences. Dantis, who invested in a flat for his daughter, has faced significant delays and is now reliant on his family for support. Raut, who sought a refund for a stalled bungalow project, has seen no progress despite securing a MahaRERA order. Advocacy groups are calling for greater transparency from MahaRERA regarding recovery figures, emphasizing the need for clarity in the recovery process to alleviate the burdens faced by homebuyers.
