The Maharashtra Food and Drug Administration (FDA) is set to broaden its scrutiny of nutraceuticals, focusing on the authenticity of ingredients, labeling, and sales practices. This initiative comes as concerns mount over misleading health claims made by supplement manufacturers. Commissioner Tukaram Mundhe expressed that the department's recent findings are troubling, noting that some products advertise ingredients that are not present in their formulations.

Mundhe clarified that the FDA's examination will encompass all aspects of nutraceuticals, including their contents, consumption guidelines, and marketing practices. This comprehensive approach aims to ensure consumer safety and uphold regulatory standards. The Advertising Standards Council of India (ASCI) has previously flagged similar issues, indicating that nutraceuticals often blur the lines between food and medicine due to their therapeutic claims.

In its annual report for 2025-26, ASCI revealed that nutraceuticals represented 52% of food and beverage advertising complaints, making them the largest category of concern. Alarmingly, 96% of these cases necessitated modifications due to misleading claims related to health benefits, including those tied to weight loss and child development. Such statistics underscore the urgent need for regulatory oversight in this sector.

Under the Food Safety and Standards Authority of India (FSSAI) guidelines, nutraceuticals are classified as food products intended to provide health benefits. However, they must adhere to strict labeling requirements, including clear indications of their category and usage instructions. Labels must also state that the products are not for medicinal use and outline any potential side effects or precautions. This regulatory framework aims to prevent misleading health claims and ensure that consumers are well-informed about the products they consume.

The Maharashtra FDA's initiative follows a national enforcement drive initiated by FSSAI earlier this year, which aimed to address similar concerns regarding nutraceuticals. The directive urged state authorities to monitor compliance closely and take stringent action against violations. As the FDA moves forward with its expanded scrutiny, consumers can expect greater transparency and accountability in the nutraceutical market.
