Nagpur Court Rules in Favor of Ashok Potbhare in Cheque Case
A Nagpur court has acquitted Ashok Potbhare in a ₹40 lakh cheque bounce case, concluding a lengthy legal dispute.
Ashok Potbhare was acquitted of allegations related to a ₹40 lakh cheque bounce.
The case stemmed from a 2013 business arrangement over manganese ore processing.
The court found insufficient evidence to establish a legally enforceable debt.
In a significant ruling, a Nagpur court has acquitted Ashok Potbhare, the owner of Shri Hanuman Minerals, from charges related to a ₹40 lakh cheque bounce case. The decision was delivered by Special Judge A.V. Dakhore, who presided over the hearing under Section 138 of the Negotiable Instruments Act. The court's verdict followed a thorough examination of arguments from both parties, witness testimonies, and supporting documents.
The origins of the dispute date back to 2013 when Sunflag Iron and Steel Company Limited and Shri Hanuman Minerals entered into a business agreement for the processing of manganese ore into silico manganese. Sunflag claimed to have supplied 857.135 metric tonnes of manganese ore, but only 40.530 metric tonnes of silico manganese were returned, leading to allegations of a shortfall of 735.545 metric tonnes. The complainant contended that the responsibility for returning the material rested with Shri Hanuman Minerals.
In 2014, a meeting was held to address the ongoing dispute, during which Potbhare allegedly agreed to return the remaining manganese. However, when he failed to do so, Sunflag issued a cheque for ₹40 lakh to cover the outstanding amount. Following the cheque's dishonor, legal action was initiated under the Negotiable Instruments Act, with Sunflag also seeking an additional ₹40 lakh in compensation.
Potbhare's defense team, comprising advocates Kamal Satuja, Kailash Dodani, and Akbar Sheikh, argued that the cheque was issued merely as a security measure and did not signify a legally enforceable debt. They contended that the mere act of issuing and dishonoring the cheque did not establish the liability claimed by the complainant. The defense also highlighted gaps in the evidence presented by Sunflag, questioning the credibility of the witness and the documentation supporting the alleged debt.
After carefully weighing the evidence and arguments, Judge Dakhore ruled in favor of Potbhare, bringing the case to a close. The acquittal signifies a pivotal moment for Potbhare, as the court found the evidence insufficient to uphold the allegations made by Sunflag Iron and Steel Company Limited. The detailed written judgment is pending, and the specific legal reasoning behind the court's decision remains to be reviewed.
