Legal restrictions affect recovery of approximately ₹209 crore.
The Maharashtra Real Estate Regulatory Authority (MahaRERA) has successfully recovered ₹9.65 crore from seven projects in the Nagpur division, addressing a significant portion of the outstanding compensation dues totaling ₹11.05 crore. This recovery was made possible through the enforcement of 19 recovery warrants, effectively clearing all pending dues associated with these specific cases.
Since its inception in May 2017, MahaRERA has been proactive in addressing compensation claims for homebuyers across the state. The authority has issued recovery orders totaling ₹1,037.86 crore in response to 1,531 complaints, with approximately ₹370 crore successfully recovered to date. This places MahaRERA at the forefront of real estate regulatory bodies in India concerning compensation recovery, with a reported recovery rate of around 45%.
In the Nagpur division, the recovery efforts have been particularly noteworthy. The ₹9.65 crore recovered represents a significant achievement, as it eliminates all pending dues for the projects involved. The authority's actions have provided much-needed relief to affected homebuyers, demonstrating its commitment to enforcing compensation orders.
However, MahaRERA's recovery operations are not without challenges. Approximately ₹209 crore remains under legal restrictions, complicating the recovery process. Of this amount, around ₹104.70 crore is tied up in cases pending before the National Company Law Tribunal (NCLT), while another ₹104.46 crore is subject to proceedings under the Maharashtra Protection of Interest of Depositors (MPID) Act. These legal hurdles underscore the ongoing difficulties in securing payments for homebuyers.
Looking ahead, MahaRERA is expected to continue its efforts to enhance recovery rates and address outstanding compensation claims. The authority's focus will likely remain on navigating legal challenges while ensuring that homebuyers receive the compensation they are entitled to. Future recovery initiatives will be crucial in maintaining the momentum achieved in recent months.
