In a significant ruling, the Bombay High Court has directed the Maharashtra government to pay Rs 2 lakh to activist Arun Ferreira, determining that his arrest outside Nagpur Central Prison in 2011 was a violation of his fundamental rights under Articles 21 and 22 of the Constitution. The Nagpur bench of the court partly upheld Ferreira's plea from 2012, ordering the state to deposit the compensation amount in court within eight weeks.

Arun Ferreira was initially arrested by Nagpur police on May 8, 2007, and subsequently faced multiple charges in Gondia and Chandrapur. After being acquitted in eight cases and discharged in one, he was released from custody on September 27, 2011, following a bail bond execution after his last acquittal. However, upon his release, Ferreira reported that he was forcibly taken by plainclothes officers from Gadchiroli police, who did not identify themselves or provide any reason for his detention, despite the presence of his family and lawyer outside the prison.

The state government contended that Ferreira was wanted in two cases related to alleged Maoist activities, justifying the use of plainclothes officers and an unmarked vehicle for his apprehension. They argued that the removal of the vehicle's number plate was a precaution due to Ferreira's status as a perceived senior member of a Naxal group. However, the court found this justification lacking, noting that there was no official record or diary entry indicating that the Gadchiroli Superintendent of Police had authorized Ferreira's arrest.

The court emphasized the importance of adhering to constitutional mandates, stating that the police had exceeded their legal authority. It highlighted that Ferreira was not informed of the reasons for his arrest, nor were his relatives made aware, which is a fundamental requirement under the law. Furthermore, when Ferreira was presented before a magistrate on September 28, he raised concerns about the nature of his arrest, but these complaints were not addressed prior to the magistrate granting custody.

Looking ahead, this ruling underscores the necessity for law enforcement agencies to operate within the legal framework, ensuring that individuals' rights are protected during arrests. The Maharashtra government is expected to comply with the court's order and deposit the compensation amount promptly, setting a precedent for future cases involving unlawful detentions.
