Finance Minister Nirmala Sitharaman has opened the door to potential changes in the long-term capital gains (LTCG) tax as the government begins preparations for the Union Budget 2027-28, which is set to be presented on February 1. Speaking at the Bloomberg New Economy Forum in New Delhi, she stated that it was premature to disclose specific considerations regarding the tax regime but acknowledged the ongoing discussions among investors both domestically and internationally.

The current LTCG tax rate on long-term gains from listed equity shares and equity mutual funds, held for over 12 months, is set at 12.5%, with an exemption limit of Rs 1.25 lakh per annum. This framework was established during the July 2024 Budget, which increased the LTCG rate from 10% and raised the exemption limit from Rs 1 lakh. Despite hopes for a reduction in rates or an increase in exemptions during Budget 2026, the capital gains tax structure remained unchanged, although the securities transaction tax (STT) on futures and options was increased.

Industry stakeholders and foreign investors have consistently raised concerns about India's capital gains tax impacting equity investments. The sentiment among foreign portfolio investors has been particularly cautious, with many opting to sell off Indian equities over extended periods this year. Sitharaman's recent comments suggest that the government is willing to consider feedback on the LTCG and STT, which could influence future investment flows into the Indian market.

Following Sitharaman's remarks, the BSE Sensex experienced a significant surge of approximately 650 points, while the NSE Nifty 50 approached the 22,600 mark. This positive market reaction reflects investor optimism that the government may be willing to revisit the tax treatment of equity gains, which could enhance the attractiveness of Indian equities amid global scrutiny of valuations and investment flows.

While Sitharaman's statements have sparked hope for potential tax relief, she did not make any firm commitments regarding changes to the LTCG tax. The fiscal implications of altering or abolishing the LTCG tax could be substantial. As the government moves forward with pre-Budget consultations with industry and investor groups in the coming months, market participants will be closely monitoring these discussions for clearer indications ahead of the February 1 budget presentation.
